Lawsuit Against Crème de la Crème Heads To Trial

THE WOODLANDS, TX -- Leger Ketchum & Cohoon, PLLC, today announces the lawsuit against Crème de la Crème daycare center is set to go to trial on Tuesday, September 7, 2021 in Montgomery County, Texas. The lawsuit, filed by Kristin and Andrew Ernest, alleges repeated neglect and abuse of their child between April 2019 and June 2019. Video surveillance obtained by court order reveals that the child was restrained for hours on end each day over several months. Often, the Ernest’s child was deprived of food, drink or engagement with staff.

“Like many of us, Mr. and Mrs. Ernest believed they found a quality daycare that would provide a safe environment for their son to learn and grow,” said Bradley Leger, Managing Member of Leger Ketchum & Cohoon, PLLC. “Crème de la Crème did not follow through on its promises and as a result, this family has been traumatized by the repeated neglect and abuse of their child.”

In the last five years, the State of Texas cited Crème de la Crème 119 times for failing to meet minimum child-care center standards. The Defendant’s conduct referenced in this lawsuit points out additional violations of the minimum standards set by the State of Texas Health and Human Services. The Ernests allege that Crème de la Crème not only failed to hire qualified staff or train existing staff, but amplified its negligence in failing to adequately supervise or manage its staff. This ordeal not only shocked the family, but left lasting effects, including the mother, Kristin Ernest, being diagnosed with PTSD that dramatically affects their everyday lives and leaves them uncertain of the long-term impact.

The Plaintiffs also allege Crème de la Crème intentionally destroyed evidence, including video surveillance of the neglect and abuse suffered by the Ernest’s child. The uncertainty of what is on those missing videos has devastated the family.

“Fighting on behalf of those who can’t fight for themselves, especially helpless children, is one of my greatest passions,” said Leger. “This is a worst-case scenario for any parent. My goal is to seek justice for this family and make sure this doesn’t happen to anyone else.”
