Attorney General Ken Paxton Ensures Baby Gabriel Receives Life-Saving Surgery

AUSTIN, TX -- Attorney General Ken Paxton has reached a resolution in the case involving baby Gabriel after ensuring that the newborn received medically indicated, life-sustaining care.

Attorney General Paxton previously secured an emergency court order protecting baby Gabriel, who was diagnosed with a serious heart condition that required surgery shortly after birth. The order ensured that baby Gabriel received life-sustaining medical care and prevented anyone from withholding treatment or removing him from the state while the case was pending. Attorney General Paxton also sent a letter to the hospitals and providers reminding them of their obligations under state and federal law to provide medically necessary, life sustaining care to baby Gabriel regardless of whether consent is provided by the intended parents.

As has been publicly reported, baby Gabriel was born and received life-saving care pursuant to the order obtained by Attorney General Paxton.

“Every child, no matter what situation they’re born into, deserves to be loved and receive the best possible care,” said Attorney General Paxton. “My office used every legal tool at our disposal to ensure baby Gabriel was able to receive the life-saving care he needed, and I’m so grateful that he has now received that care. I ask every Texan to continue praying for his health. I will never stop fighting to defend innocent life and protect those who cannot fight for themselves.”

With the child’s immediate medical needs secured and the purpose of the emergency intervention achieved, Attorney General Paxton has filed a notice of nonsuit.
