Scardino Convicted in Violent Family Assault, Sentenced to 50 Years

MONTGOMERY COUNTY, TX -- A Montgomery County jury found 34-year-old David Alexander Scardino guilty of Aggravated Assault Causing Serious Bodily Injury with a Deadly Weapon involving Family Violence following a four-day jury trial in the 435th District Court, presided over by Judge Patty Maginnis.

The case was tried by Mary Garcia and Evan Bilicek of the Montgomery County District Attorney’s Office Domestic Violence Unit. Trial commenced on January 26, 2026, and after less than one hour of deliberation, the jury returned a guilty verdict on January 29, 2026. Judge Maginnis sentenced Scardino to 50 years in the Texas Department of Criminal Justice later that day.

The conviction stems from a violent incident on April 18, 2025, when deputies with the Montgomery County Sheriff’s Office were dispatched to a disturbance that escalated into a reported stabbing at the couple’s residence. The complainant reported to a neighbor and responding deputies that her husband, David Scardino, had stabbed her multiple times and assaulted her with metal knuckles.

The victim was transported to the hospital, where she was treated for life-threatening injuries, including an orbital fracture, multiple stab wounds, and a wound that fractured a rib and punctured her lung.

During trial, the victim testified that her husband was not the individual who attacked her. Despite that testimony, the jury heard extensive evidence from neighbors, law enforcement deputies and detectives, and medical professionals, as well as surveillance video showing Scardino leaving the residence immediately after the assault. That evidence clearly established Scardino as the perpetrator and formed the basis for the jury’s guilty verdict.

During the punishment phase of trial, the court heard evidence regarding Scardino’s prior felony convictions, which were considered during sentencing. The court also heard testimony from both the victim and the defendant before imposing the 50-year sentence.

This case highlights the challenges that can arise in intimate partner violence prosecutions, including issues related to victim cooperation. The victim was present throughout the proceedings and testified during both the guilt-innocence and punishment phases of trial.
