Montgomery County Sheriff's Office makes arrest in Holly Ridge murder case

THE WOODLANDS, TX - On May 3, the Montgomery County Sheriff’s Office Homicide and Violent Crimes Division, Gang Task Force Detectives, and MCSO SWAT served an arrest warrant on known gang member and wanted murder suspect Roberto Ausencio.

Ausencio was taken into custody without incident and is currently confined in the Montgomery County jail, where he is charged with the murder of Rufino Gutierrez. This murder appears to be narcotics related.

Sheriff Rand Henderson said, “Even as our deputies were assisting in the massive manhunt for Franciso Orepesa, our agency continued to investigate this case. I could not be more proud of the detectives that worked tirelessly to solve this case and bring a dangerous gang member and murderer off the streets of Montgomery County. We will not tolerate this type of violent lawlessness in our County, and justice will be served.”

Rufino Gutierrez, 34, of Porter, was discovered on April 23 at about 9:25 pm, when deputies responded to the 23000 of Holly Ridge in Porter for a suicide with a weapon call. Upon arrival, deputies discovered Gutierrez dead from an apparent a gunshot wound. Preliminary investigations indicated that this was not a suicide but a homicide. The Montgomery County Sheriff’s Office Homicide and Violent Crimes detectives continued to actively investigate this homicide.
