Predator’s reign of abuse ends with 60-year prison sentence

THE WOODLANDS, TX – A Montgomery County jury in the 221st District Court delivered a decisive 60-year prison sentence to 33-year-old Heriberto Hernandez, a resident of Honduras, after convicting him of Aggravated Sexual Assault of a Child.

The trial commenced on Monday, August 4, 2025, with Chief Prosecutor Laura Bond selecting a jury before the Honorable Judge Lisa Michalk. Over two days, jurors heard compelling testimony from six witnesses, including law enforcement, medical professionals, a forensic interviewer, the victim’s mother, and the child herself.

The 13-year-old victim bravely testified in open court, recounting the three years of abuse she suffered at the hands of the defendant. Her powerful testimony gave jurors a clear and compelling picture of the trauma she endured.

The investigation began when the victim’s mother discovered a series of letters between her daughter and the defendant. She turned the letters over to the Montgomery County Precinct 3 Constable’s Office, whose investigators quickly launched an in-depth investigation that ultimately led to Hernandez’s arrest and prosecution.

On August 5, 2025, the jury returned a guilty verdict. During the punishment phase, Chief Prosecutor Laura Bond introduced additional evidence of Hernandez’s Aggravated Assault with a Deadly Weapon, further highlighting the danger he poses to the community. Bond urged the jury to hand down a strong sentence, telling them, “The only way to keep him from doing this again is to incarcerate him. He committed a horrible crime, and he is violent.”

The jury agreed, sentencing Hernandez to 60 years in prison — the full punishment Bond requested. Under Texas law, Hernandez will be eligible for parole after serving 30 years.
