Jury Delivers 60 Years in Prison to Child Predator

THE WOODLANDS, TX -- A young child’s courageous decision to come forward and disclose abuse led to the conviction of a Montgomery County man who will spend the next 60 years in prison for repeatedly sexually assaulting that child.

On July 22, 2026, a Montgomery County jury convicted Josean Michael Vallejo, 31, of two counts of Aggravated Sexual Assault of a Child and one count of Indecency with a Child by Contact following a three-day trial before the Honorable Lisa Michalk, sitting for the 221st District Court. The trial commenced on July 20, 2026.

The investigation began after the child disclosed repeated sexual abuse to a trusted adult. Montgomery County Sheriff’s Office Detective Max Fruchtnicht led the investigation. As part of the investigative process, the child participated in a forensic interview at Children’s Safe Harbor and underwent a Sexual Assault Nurse Examiner (SANE) examination.

Evidence presented during trial established that Vallejo repeatedly sexually assaulted the child over an extended period and used manipulation and grooming to facilitate the abuse. Jurors also heard testimony regarding the defendant’s explanation for his conduct before finding him guilty on all three counts.

Following the guilty verdicts, the jury assessed punishment at 60 years’ imprisonment on each count of Aggravated Sexual Assault of a Child and 20 years’ imprisonment for Indecency with a Child by Contact. The Court ordered the sentences to run concurrently, resulting in a total sentence of 60 years in the Texas Department of Criminal Justice.

Assistant District Attorneys Ann Kuykendall and Erin Delano prosecuted the case on behalf of the State of Texas.

“Every child deserves to know that when they tell the truth, there will be adults who listen, who believe them enough to investigate, and who will fight to protect them. That responsibility belongs to all of us. It was an honor to stand beside this child and help ensure that responsibility was fulfilled,” said Assistant District Attorney Ann Kuykendall.

District Attorney Mike Holley said the case is a reminder of what justice demands when a child has been exploited. “There is no sentence that can restore a stolen childhood. But every conviction like this serves another purpose: it removes a predator from our community and affirms that children who come forward will not have to stand alone. That is a promise this office will continue to keep,” Holley said.
